These terms of use govern your use of our products and services, including the use of our website Our privacy policy is also provided.  These terms of use form a binding contractual agreement between you and us. If you do not agree to these terms of use, please do not use our products and services or our website.  You are taken to have agreed to these terms of use if you use our website or you set up an account with us. If you agree to these terms of use and you use our website, you represent and warrant to us that you have the legal capacity to enter into these terms of use.

2. Privacy policy

DietitianChong Pty Ltd ACN 613 884 398 (DietitianChong) respects your right to privacy and this policy sets out how we collect and treat your personal information.  The following privacy policy applies to all DietitianChong users, and conforms to Internet privacy standards.Personal information is information we hold which is identifiable as being about you and includes sensitive information such as health information.

2.1 Collection of your personal information

(a) We only collect information from you that you voluntarily give us. We may collect the following types of personal information from you: name, address, phone number, email address, IP address of the computer you are using, information about the goods or services you have ordered, information from enquiries you have made, communications between us, financial information (such as credit card and debit card information, expiration date and ccv), your age and medical information.  For some of our products and services, we may be required to collect and hold your sensitive information.

(b) If you request for any special dietary requirements, you may also be required to provide your personal information such as gender, height and weight, existing medical conditions and any medically diagnosed allergies or food intolerances, in order for us to customise a menu plan for you.

(c) We collect and store personal information received via correspondence from you. This may be via the telephone, email, mail, fax or directly through our website and through interaction with the DietitianChong team (including agents or contractors to DietitianChong such as courier or delivery company).  

(d) Correspondence is recorded in order to provide service references and to assist in our team development and training.

2.2 Use of your personal information

(a) We use your personal information to provide our products and services to you and so that you can use our website. We also use it to improve our products and services and to notify you of opportunities that we think you might be interested in.

(b) We may store your personal information in locations outside the direct control of DietitianChong, for example, on servers or databases co-located with hosting providers.

(c) We do not provide your information to third parties, except that we may provide your information to our business partners who assist us in the provision of our services to you. We may at our discretion use other third parties to provide essential services on our site or for our business processes. We may share your details as necessary for the third party to provide that service.

(d) We do not collect your personal information for any third party agent/service providers not directly related to DietitianChong and do not collect or share any information with third parties for any unknown or unrelated uses.

(f) We may also disclose your personal information to other companies within the DietitianChong group. We do everything to ensure your personal information is kept secure from unauthorised access or disclosure.

2.3 Storage of your personal information

(a) We take every reasonable precaution possible to protect your personal information and follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

(b) When credit card details are collected, we pass them onto our CommWeb provider in order to be processed as required. We never permanently store complete credit card details.

(c) We are not liable for any unauthorised access to your personal information.

(d) We do not collect your personal information for any third party agent/service providers not directly related to DietitianChong and do not collect or share any information with third parties for any unknown or unrelated uses.

2.4 Access to and correction of your personal information

(a) You may request access to, or have corrections made to your personal information by contacting us at or on +61 (02) 9152 8764. We reserve the right to charge a reasonable administration fee for this access.

(b) If you no longer desire our service or no longer wish to receive some or all of our communications, you may correct, update, delete or deactivate your personal information by contacting us at or on +61 (02) 9152 8764.

2.5 Communications

(a) DietitianChong uses personal information for essential communications, such as emails, SMS, accounts information, and customer service details. From time to time, we may also use this information for other purposes, including to send you SMS order reminders and newsletters and to inform you about new products, offers, promotions and information that we think is relevant to you.

(b) When you become our customer, you consent to us using your personal information for direct marketing purposes (for an indefinite period), unless you have contacted us to withdraw your consent.

(c) If you do not wish to receive marketing material from us, you can opt out at any time by requesting to be removed from any mailing lists by unsubscribing or contacting us at or on +61 (02) 9152 8764.

(d) If you request not to receive marketing material, please note that we will still contact you in relation to our ongoing relationship with you. For example, we will still send you any bills, statements and notices that are relevant to the products and services you hold with us.

2.7 Cookies and IP address

(a) We use cookies on our website to identify you when you come back to our website, to store details about your use of our website and to improve your experience using our website. Cookies are pieces of information that a website transfers to an individual’s hard drive for record keeping purposes. We do not use cookies to identify specific individuals or for the operation of our site.

(b) Most browsers are initially set to accept cookies. If you prefer, you can set yours to refuse cookies or to alert you when cookies are being sent.  If you disable cookies, you may also disable many features available through our website.

(c) We do not control advertising cookies sent by third party servers, and a different cookie policy may apply to them. If you have received a cookie from one of our advertisers, we may use the existence of the cookie to measure an advertiser’s performance but we do not store any information linking that cookie with your account

(d) When you click something on our website, you give us the address of your computer (the IP address) so our website can deliver the new page to you. We do log which pages are displayed to which IP addresses so we can tell what pages on our site are used as part of a visit, and so we can troubleshoot problems. There is no personal information collected in our log files. We do not automatically log personal data nor do we link information automatically logged by other means with personal data about specific individuals while you are merely viewing our website.

(e) If you place an order online using a credit card, we specifically record your IP address with the use of the credit card as part of our fraud prevention measures.

2.10 Changes to our privacy policy

We can change our privacy policy as our business requires or as the laws change. We reserve the right to modify this privacy policy at any time, so please review it frequently. If we make material changes to this policy, we will notify you here, or by email, or by means of a notice on our homepage.

3. Terms of use

These terms of use govern your use of our website and form a binding contractual agreement between you and us. You should read them carefully. You are taken to have agreed to these terms of use if you use our website or you set up an account with us. If you do not agree to these terms of use, please do not use our website

3.1 Your account with us and payment method

(a) Your account with us is strictly between you, the account holder, and DietitianChong. Account balances are not transferable from an account holder to another party.

(b) We accept Visa and Mastercard credit or debit credit cards. If you pay by card, your card will be charged in advance for the full value of the total order. All payments must be made before your order can be delivered. Payment must be made by the account holder through Commonwealth Bank of Australia (CommWeb), the company responsible for facilitating the secure direct debit payment system on behalf of DietitianChong in accordance with the DietitianChong terms and conditions.

(c) You must have sufficient funds or credit available at the time of each transaction. Transactions for meal payments are one-off for the menu ordered. If you do not have sufficient funds available at the time of the transaction the menu will not be submitted for the next scheduled delivery day.

(d) Accounts for paid orders are classed as a one-off transaction between the account holder and DietitianChong. 

(e) All fees stated for meals are inclusive of GST.

(f) After ordering and paying online, you will receive an email confirmation from DietitianChong containing your payment details.

3.2 Meal orders

(a) Meal orders placed and paid for, are for one (1) order only and do not rollover to the following week, unless stated by you.

(b) We will use any personal information we may collect from you when you purchase a product or service from us for billing purposes, order clarification and to fulfil your purchase request. If we have trouble processing an order, we will use this information to contact you.

(c) If you request that we rollover an order via your account, you give us permission to place an order on your behalf and take payment via Commonwealth Bank of Australia (CommWeb). All details are secure and we will simply process your previous order in the system. Our menu are updated regularly. We will notify you should any meals are unavailable before we process the order.

(d) Accounts for paid orders are classed as a one-off transaction between the account holder and DietitianChong. 

(e) All fees stated for meals are inclusive of GST.

(f) After ordering and paying online, you will receive an email confirmation from DietitianChong containing your payment details.

3.3 Delivery policy

(a) Delivery policy.

(i) DietitianChong schedules deliveries to on different days. Delivery days are subject to temporary change during special events local to you and on public holidays.

(ii) Delivery areas are currently within Sydney Metro only. Please check our online postcode checker located on the footer of on the product pages or with us by telephoning +61 (02) 9152 8764 to find out if we deliver to your area. Orders for delivery outside of the Delivery Areas will not be processed.

(iii) Delivery areas also incur an additional delivery fee.

(iv) You cannot alter:

(A) the set delivery day for your area;

(B) the delivery address, once you have placed an order;

(v) You will receive one delivery per order. Your order will be delivered at any time on your scheduled delivery day. Unfortunately, we cannot give or adhere to a request for a specific delivery time. If you are not home when we deliver your order, we will leave the order with ice packs at the front door in an area specified by you in the online order form.

(vi) If you live in a secured apartment complex or if you requested office building delivery, please ensure you are available to receive your delivery.

(vii) DietitianChong accepts no liability for the loss or deterioration of any goods once they have been delivered in accordance with your delivery instructions and our terms and conditions. To the fullest extent permitted by law, DietitianChong will not be held liable for any financial or physical damages of any kind.

(viii) DietitianChong will not replace or provide a refund for any meals ordered by you by mistake. You must notify us if you have received an incorrect meal or are missing a meal within 24 hours of delivery by phone on +61 (02) 9152 8764 or email us at Missing meal items will be either refunded to you by the same payment method used initially or a coupon code will be created to be used with your next order.

(ix) Failure to comply with these policies will result in no replacement meal, refund or credit.

(a) Delivery days and cut off times.

Cut off times for order are based on the customer’s local time. DietitianChong reserves the right to change or alter delivery days and cut off times without notice.

3.4 Order cancellation policy

Due to the nature of our business we require a minimum notice of 48 hours prior to cut off time mentioning your intention to cancel your order. This must be done by calling us on +61 (02) 9152 8764 or email us at If you do not notify us in accordance with this clause, you will be charged the full amount of the order. We will endeavour to process your refund the following day less administration cost of AUD $5.00.

3.5 Refund and returns policy

This return and refunds policy covers refused and returned orders due to system error, customer error and driver inability to safely and correctly deliver an order. The policy does not apply to goods which have been open, used or damaged after delivery, or if any attempt has been made to alter the product.

(a) Erroneous delivery.

(i) If for any reason you receive a delivery in error, you must contact us on +61 (02) 9152 8764 within six (6) hours and we will exchange your order and delivery to you within the next available delivery time.

(ii) Failure to contact us within the designated time will deem the goods spoiled and your acceptance of the delivery, which you will be charged for.

(b) Refusal of delivery

(i) Should a customer or any person located at the delivery address (home or business) refuse the delivery, the goods will be returned to the kitchen. Refused or returned deliveries will be kept at our kitchen for two (2) days only and the customer must make arrangements with our team for next delivery. Additional delivery cost incur. Goods will be disposed after two (2) days of return as per our food health and safety policies.

(ii) Customers bare all costs associated with the refusal and return of any order to our kitchen.

(b) Refunds

(i) DietitianChong will refund payment in the event that there is a confirmed error on our end and you have been incorrectly charged.

(ii) Failure to adhere to our terms and conditions will prohibit any refunds or credits being issued to you.

(iii) There will be no refunds where you have not adhered to the payment terms and policy of Commonwealth Bank of Australia (CommWeb).

3.6 Meals, allergies and food intolerances

(a) Meals.

(i) DietitianChong meals are designed for general healthy eating.

(ii) If you require specific dietary guidance including pregnancy/breastfeeding, specific age groups such as children/teenagers or if you have an existing medical conditions, we strongly suggest that you consult your Doctor or contact our Dietitian by telephoning +61 (02) 9152 8764 prior to ordering or consuming any products.

(iii) It should not make up the entirety of daily food consumption unless you purchase the full nutritional plan or daily meal package.

(iv) Nutrient values are based on estimates derived from the AUSNUT 2013 database. Variations may occur due to average weights of ingredients. Use as a guide only.

(b) Allergies and food intolerances

(i) While we take all due care to keep allergy prone ingredients out of certain meals, please take note that they may still be present.

(ii) It is the customer’s responsibility to check the nutritional panel, ingredients list and allergen information from our website at before purchase.

(iii) We cannot guarantee our products are completely free from any allergens such as milk, nuts, egg, sesame seeds, fish, crustacean, soy, sulphites and gluten.

(iv) We accept no liability for any allergic reaction by a customer as a result of consuming a DietitianChong products.

(v) We do have meals available that contain no gluten containing ingredients. If you are medically diagnosed as being a coeliac, it’s important you know that while we take all due care to minimise contamination of our Gluten Free meals, we do not test our meals for gluten and they may contain traces.

(vi) If you have a life threatening allergy, we strongly advise not to consume any commercially prepared ready to eat meals, including those prepared by DietitianChong.

3.7 Product and ingredients quality

(a) We endeavour to ensure all our ingredients are of the highest quality. However due to occasional unforeseen issues, such as weather or logistics, some produce may not be available. DietitianChong reserves the right to substitute where necessary with other produce, and will take the utmost care to source the best quality alternative options.

(b) As we are using third party suppliers, we do not accept liability for errors or inaccuracies of product information supplied by our suppliers.

(c) Note that our meals are packed and portioned according to weight and that quantity/pieces shown in images may vary from what you receive each delivery. To ensure quality, our kitchen follows a tight ship when it comes to packing each meal with regular audits to ensure you get the right amount and quality ingredients each and every time.

3.8 Product handling

(a) We provide our meals chilled and transported within a temperature controlled environment. Upon received the meals, you must store it in a refrigerator of below 5 degrees celsius immediately for food safety reasons.

(b) DietitianChong meals have a 3-4 day shelf life depending on the ingredients used. Meals should not be eaten after the use by date expires.

(c) Some meals/snacks have a longer shelf life depending on the ingredients used. Always check the ‘use by date’ before consumption.

(d) It is not recommended to freeze the meals unless specifically stated on packaging.

(e) Heating instructions must be followed as stated on the meal containers. We recommend to re-heat the food in a microwave or on the stove to a temperature of at least 65 degrees celsius or hotter. Heating times are a guide and may vary depending on customer’s appliance.

(e) We accept no responsibility for products that are not stored as instructed or re-heated according to DietitianChong instructions prior to consumption.

3.9 Promotional and discount vouchers

(a) Promotional and discount vouchers and gift vouchers are non-transferable and non-refundable and can be redeemed as per the voucher terms and conditions.

(b) If a discount or promotional voucher is purchased, where the terms and conditions of use have not been adhered to, DietitianChong will not refund and accepts no responsibility.

(c) By purchasing a promotional and discount voucher or gift voucher from us, you accept the terms and conditions contained within this document.

3.10 Intellectual property

Nothing in these terms of use constitutes a transfer of any intellectual property rights.  You acknowledge and agree that, as between you and us, we own all intellectual property rights in our goods and services, the website and the content on the website.

3.11 Limitation of liability

To the fullest extent permitted by law:

(a) you acknowledge and agree that in no event will DietitianChong be liable to you for any loss or damage arising out of any misrepresentation (unless fraudulent), negligence, your use of our goods or services, your use of our website, or a breach (express or implied) by us or any related third party of the privacy obligations set out in the privacy policy or these terms of use; and.

(b) we exclude all representations, warranties or terms (whether express or implied) other than those expressly set out in these terms of use.

(c) we will not be responsible or liable for failure to perform any obligation under these terms if such failure is caused by the occurrence of any matter beyond its reasonable control including, without limitation, industrial disputes, internet and communications outages, fire, flood, war, explosion, accident or other.
